Debt collection and recovery in the UAE
Unpaid invoices, loans between parties and bounced cheques, recovered efficiently: from a firm demand notice through to enforcement.
Most debts in the UAE can be recovered through a sequence of steps: a formal legal notice, a fast-track payment order where the debt is documented, direct execution of a bounced cheque, or a full court claim where the debt is disputed.
We choose the quickest route your documents allow, keep negotiation open throughout and, once you have an order or judgment, take the enforcement steps that turn it into payment.
How we can help
Legal notices and demand letters
A properly drafted legal notice often secures payment on its own, and it is a required first step for some procedures. We set out the debt, the deadline and the consequences clearly.
Cheque bounce and promissory note claims
A bounced cheque can be presented for direct execution through the courts as an enforceable instrument, which is often faster than an ordinary claim. We check the cheque and the bank certificate and prepare the file.
Payment orders and court recovery claims
Where the debt is written and fixed, a payment order can be faster than a full lawsuit. Where it is disputed, we prepare a court claim with the evidence it needs.
Attachment, enforcement and settlement
After an order, execution can reach bank accounts, salaries, vehicles and property, and can include a travel ban request. We pursue enforcement while staying open to a sensible settlement.
Business debt portfolios
For businesses with several overdue accounts, we review the ledger, prioritise by documents and value, and run the files in a consistent way.
From first call to resolution
Review the documents
Invoices, contracts, statements, cheques and correspondence decide which route is available and how fast it can be.
Formal demand
We send a legal notice with a clear deadline, and open a channel for settlement.
Choose the procedure
Cheque execution, payment order or court claim, depending on the documents and whether the debt is disputed.
Order or judgment
We prepare the filing and supporting evidence, with Arabic translation where required, and coordinate with licensed counsel for any court appearance.
Enforce
We take execution steps against accounts, salary or assets, and close the file with a written settlement where one is reached.
Bounced cheques after decriminalisation
Since January 2022, issuing a cheque that bounces for insufficient funds is no longer a crime in most cases in the UAE. That changed how cheques are used in recovery rather than weakening them: a bounced cheque is treated as an enforceable instrument, so the holder can apply for direct execution for the unpaid amount instead of starting a full lawsuit. Some conduct involving cheques, such as fraud or deliberately stopping payment in bad faith, remains criminal. Our guide on what happens when a cheque bounces explains both routes.
What makes a debt quick to recover
- A written contract, signed invoice or acknowledgement of the amount.
- A cheque, promissory note or other negotiable instrument.
- Correspondence in which the debtor accepts the debt or promises payment.
- Knowing where the debtor banks, works or holds assets, which matters at enforcement.
If the debt is owed by a company in financial difficulty, collection may overlap with insolvency proceedings, where creditors file claims rather than enforce individually. See our insolvency page.
Debt Collection: your questions
Usually a formal legal notice setting out the amount and a deadline. It often brings payment or a settlement offer, and it prepares the ground for a payment order or claim if it does not.
Yes. Although most bounced cheques are no longer criminal, the cheque can be presented for direct execution through the courts for the unpaid amount, which is often faster than an ordinary claim.
A notice may settle a debt within weeks. Payment orders and cheque execution are designed to be faster than full claims. Contested lawsuits and enforcement take longer. We give you a realistic estimate once we see the documents.
Sometimes. A UAE judgment can be enforced in some other countries, including India, where UAE court decrees can be executed. We look at where the debtor has assets before advising.
