Banking and finance advice in the UAE
For banks, finance companies, businesses and borrowers: lending and security documents that hold up, and recovery that follows the rules.
Banking and finance work in the UAE covers the documents behind lending, such as facility agreements, mortgages and guarantees, and the disputes that follow when repayments stop.
We draft and review lending and security documents, advise lenders and borrowers on their rights and obligations, pursue or defend recovery of defaulted facilities and credit cards, and advise on regulatory and compliance questions, including anti-money laundering obligations.
How we can help
Loan, facility and credit agreement drafting and review
Facility letters, term loans, revolving credit and finance agreements: we check repayment terms, events of default, interest and fees, and the remedies each side really has.
Mortgage, guarantee and security documentation
Security is only as good as its registration and wording. We prepare and review mortgages, personal and corporate guarantees, pledges and assignments.
Recovery of defaulted loans and credit card debts
For lenders, we run recovery from notice to enforcement. For borrowers, we review the claim, the calculation and the options to settle.
Regulatory and compliance advisory
We advise on customer due diligence, record keeping and anti-money laundering obligations, and on how compliance requirements affect a transaction.
From first call to resolution
Understand the transaction or dispute
Who is lending, what is secured and what has gone wrong, if anything.
Review the documents
We identify gaps, unclear terms and registration issues before they become problems.
Advise in writing
A short written note of the risks, the options and our recommendation.
Draft, negotiate or recover
We prepare the documents, negotiate amendments or take the recovery steps agreed with you.
For lenders
Recovery starts long before a default. Clear events of default, properly executed guarantees, registered security and good records make every later step faster. When a facility does go into default, we prepare the notice, choose between payment order, cheque execution and a full claim, and pursue enforcement against the security and the guarantors.
For borrowers and guarantors
If you have signed a guarantee or taken a facility that has run into difficulty, the earlier you take advice the more options you have. We check the bank's calculation of the amount claimed, the interest and charges, and whether the security and guarantee were validly given. We then negotiate a settlement or restructuring, or prepare a defence. Settlements with banks are covered in detail on our bank settled disputes page.
Compliance
Businesses that handle client money or high-value transactions face real anti-money laundering obligations in the UAE, from customer due diligence to record keeping and reporting. Our team includes advisers with AML compliance experience who can review policies and transactions in practical terms.
Banking & Finance: your questions
Both, though never on both sides of the same matter. We check for conflicts before we take on any banking file.
Yes, if it was validly given and the conditions in it are met. We review the guarantee wording and how it was signed before advising either side.
The lender usually sends notice, may call the facility and can pursue the borrower and guarantors through the courts. Early negotiation often produces a better result for both sides.
Fees are quoted after the first consultation, based on the documents and the work involved, and agreed in writing before we start.
